PERSONAL DATA PROTECTION NOTICE
 

INTRODUCTION

HINO MOTORS SALES (MALAYSIA) SDN BHD (“HMSM”) respects and committed to protect your personal data and privacy. The Personal Data Protection Notice (“Notice”) is issued in accordance with the Personal Data Protection Act 2010 (“PDP Act”) in order for HMSM to collect, process and use your personal data. For the purpose of this Notice, Personal Data shall have the meaning as stipulated under the PDP Act. Unless otherwise stated, capitalized terms herein shall have the same meaning as stipulated under the PDP Act.

Type of Personal Data

Your personal data may include name, identification number, passport number, address, contact number, email address, mailing address, bank account number, credit or debit card details and/or any other relevant information prescribed under the PDP Act (“Personal Data”)

Source of Personal Data

HMSM may collect the personal data directly and/or indirectly from the Customer, Dealer and/or Vendor, from any third parties, website, company and/or any public sources to the extent authorized by the law and necessary for HMSM business.

Purpose of Collect, Process and Use

During your course of dealing with us, your Personal Data shall be collected and processed by HMSM for the purposes of providing you information about HMSM products and/or services, providing HMSM services, facilitating your purchase of HMSM products, providing your personal information of new products as requested by the new purchaser, to carry out the obligations and/or transactions you have requested, agreed and/or authorized HMSM to do so, to request additional information on the feedback that you may provide about HMSM products and/or services which currently use by you, to obtain response in relation to HMSM products and/or services, to provide you with advance notice about HMSM events in order for you to participate into HMSM events and/or programme, to provide you with HMSM latest products and/or services and/or other purposes referred to in HMSM Personal Data Protection Policy (“Purposes”). HMSM will not use your Personal Data beyond the purpose authorized under any law and regulations.

Sensitive Data

HMSM will not acquire, use or disclose to any third party on any sensitive personal data including information as to political affiliation, medical condition, ethic group, religion or any other sensitive personal data as prescribed in PDP Act from time to time unless is authorized by the law.

Disclosure of Personal Data

Your Personal Data provided to HMSM shall be kept confidential in general except the following in order for smooth business transaction with HMSM: -

1. Any person to whom HMSM are compelled or required to do so under law or in response to a competent or government agency;
2. Hino Motors Ltd, Hino Group of Companies in overseas and affiliates and/or any other subsidiaries established in the future;
3. HMSM appointed Dealers and/or Services Centre;
4. HMSM appointed vendors and suppliers;
5. HMSM appointed agents and service providers which HMSM engaged and/or appointed on HMSM product in order to assist HMSM product and services whereby they are bound to protect your Personal Data therein;
6. HMSM auditors, consultants, accountants, lawyers or other financial or professional advisors;
7. Any person who may be necessary and undertakes to keep your Personal Data confidential;
8. Any other party which you have consented to release to and any other third parties stipulated in HMSM Personal Data Protection Policy, which may be located within Malaysia and/or outside of Malaysia, for reason relating to the Purposes.

Data Transferred and Shared Usage

HMSM may transfer and share your Personal Data outside of Malaysia for the purpose of data storage and processing and when it’s necessary for such transfer and share of your Personal Data for the Purposes.

Management of Personal Data

HMSM is committed to maintain and stored your Personal Data in a secure and appropriate manner. HMSM is committed prevent the unauthorized or unlawful processing of your Personal Data, the accidental loss or destruction of, or damage to, or falsification of, or leakage of your Personal Data by implementation of appropriate administrative and security procedures whenever practicable.

Retention of Personal Data

Your Personal Data shall be retained by HMSM for as long as it is necessary for HMSM to carry out the Purposes with your consent. Your Personal Data will be disposed in an appropriate manner when there is no necessity for HMSM to collect, process and use your Personal Data.

Rights of Access and Correction

It will be necessary for HMSM to process your Personal Data for the Purposes, without which we will not be able to carry out the Purposes. For further information on this matter, kindly refer to HMSM Personal Data Protection Policy at https://www.hino.com.my. You may request for access to or correction of your Personal Data or limit the processing therein at any time hereafter by submitting such written request to HMSM: -

Any inquiries or complaints with respect to your Personal Data should also be channelled to HMSM in this manner.
 

Consent

By submitting your Personal Data to HMSM, you hereby consent for HMSM to collect, process, use and disclose your Personal Data in accordance with this Notice. You hereby confirm that your Personal Data provided to HMSM is accurate, complete and up-to-date. In the event of any changes, you shall promptly update HMSM of such changes on your Personal Data. You also hereby represent and warrant that the consent of third parties whose Personal Data you have provided and disclosed to HMSM have been sufficiently obtained to allow HMSM to process the same in relation to the Purposes.

HMSM Right to Amend

HMSM reserves the right to update and amend HMSM Personal Data Protection Policy and this Notice from time to time. Such amendments will be announce to you via our website and/or any other appropriate mediums. Such amendments shall only apply to Personal Data collected after the effective date of such revised HMSM Personal Data Protection Policy and Notice.

Language

This Notice is issued in both English and Bahasa Malaysia in accordance with Section 7(3) of the PDP Act. In the event of any inconsistencies, the English version shall prevail.
